La découverte de l'art rupestre et des gravures pariétales a montré que l'art a accompagné l'homme tout au long de son existence. La jouissance de celui-ci à travers le temps a conduit au développement de diverses activités, liées à sa promotion et à son exploitation, dont découlent des avantages indéniables. Les gains matériels issus de l'activité artistique profitaient initialement aux exploitants, à l'exclusion des créateurs. La mobilisation de ces derniers, regroupés au sein de collectifs a permis de mener des revendications aboutissant à la reconnaissance et à la consécration des droits de propriété littéraire et artistique, à la fin du 18e siècle. Les organisations de revendication se sont muées en organismes de promotion de l'activité artistique, de défense des intérêts patrimoniaux et extrapatrimoniaux, de perception et de répartition des droits : les organismes de gestion collective ou sociétés de perception et de répartition des droits étaient nés. Les enjeux des droits de propriété littéraire et artistique pour la société toute entière ont poussé les pouvoirs publics à légitimer la gestion collective dans les missions d'intérêt général qu'elle est amenée à accomplir. Les organismes de gestion collective se sont vus investis de missions de service public, pour lesquelles d'importantes ressources sont mobilisées. En lui assurant les meilleures conditions d'accomplissement de ces missions, les pouvoirs publics se ménagent un droit de regard qui se traduit dans la maîtrise et le contrôle de la gestion collective.

The discovery of the rock art and the parietal enravings showed that the art accompagnie human being troughout its existence. The enjoyment of this one through the time led to the development of diverse activities bound to its promotion and to its exploitation, from which result undeniable advantages. The material earnings stemming from the artistic activity benefited initally the developpers, with the exception of the creators. The mobilization of the latter, grouped within collectives allowed to lead claiming ending in the recognition and the consecration of the literary and artistic property rights, et the end of the 18th century. The orgazations of claiming changed into bodies of promotion of the artistic activity, the defense of the material and extrapatiomonial interests, the perception and the distribution of the royalties : the institutions of collective management or sociéties of perception and distribution of the royalties had been born. The stakes in the rights of literary and artistic property for the whole society urged public authorities to legitiize the collective management in the missions of general interest which it is brought to carry out. Institutions of collective management were invested with missions of public service, for which the important resources are mobilized. By assuring him the best conditions of fulfillment of these missions, public authorities leave the right to inspect which is transleted in the control of the collective management.
